非法拘禁罪中不乏暴力行为。不同阶段或不同目的的暴力行为,有着不同的法律后果。     

Legal migration and illegal migration: the effectiveness of qualitative and quantitative restriction policies

By considering the optimal behaviour of illegal mi grants who must confront the various enforcement techniques adopted by the host country, we show that an increase in penalties, in travel cost, or in the possibility of detection, would be effective in the 'qualitative ' objective but not in the 'quantitative' objective. Moreover. when a host country starts accepting skilled legal migrants, if the required skill level is relatively low and the possibility of detection is sufficiently high , an increase in penalties will be effective in both objectives.     

论破坏国家重点保护野生动物资源的犯罪

《野生动物保护法》将珍贵、濒危野生动物列为国家重点保护的野生动物 ,并规定了管理、保护制度。 1 997年《刑法》新增了非法猎捕、杀害珍贵、濒危野生动物罪和非法收购、运输、出售珍贵、濒危野生动物、珍贵、濒危野生动物制品罪 ,从而完善了我国对野生动物的法律保护体系。本文就两个罪名的法律构成 ,以及司法实践中的有关问题展开讨论。     

现实与法律的冲突和规制——基于利益衡平视角的拆迁中违章建筑补偿问题探究

中国正在社会转型,社会变迁带来纠纷增长,矛盾凸显,我国已进入了高风险社会。拆迁被称为当今"天下第一难事",其中违章建筑的拆迁补偿问题尤为复杂,理论界和实务界分歧很大。违章建筑到底该不该补偿,大多数学者对于违章建筑的定性,一定程度上将原本属于两个层面的问题混淆到一个层面,容易导致对违章建筑定性的模糊不清。对于违章建筑的补偿不应采取"一刀切"的标准予以全部否定,应对违章建筑的定义、财产性质及权属进行详细地分析,揭开违章建筑的面纱,进行甄别,然后在市场比较法、收益法的基础上提出新型的租金定价模式。     

Hospitality managers' importance perceptions of human resource practices related to employment of foreign workers in the United States

ABSTRACT

Cross-border labor mobility of hospitality employees has resulted in an increase in illegal immigrants in the workforce. The purpose of this study was to generate a list of top legal issues associated with the employment of foreign workers in the U.S. hospitality industry and to identify factors defined by the importance ratings of these issues. Snowball sampling was used to collect data from hospitality managers. Findings reveal that respondents perceive document verification to be important but may not perceive knowledge of various visa types and employment termination reporting procedures associated with employing foreign workers to be important. Managerial implications are discussed.     

扣缴行为的类型化研究

通过对传统的扣缴义务和扣缴行为的反思,建议从"广义的扣缴义务"和"广义的扣缴行为"的新视角出发,并引入全面履行和适当履行的双重标准,兼采扣缴制度本身的法定主义,将扣缴行为从外部界定为合法扣缴行为、脱法扣缴行为和法外空间;从内部将脱法扣缴行为类型化为不履行、不完全履行和迟延履行三种形态。进而对不同类型的税法评价进行研究,对合法扣缴行为进行肯定的评价,对脱法扣缴行为做出不同程度的否定评价.而对法外空间则归于税收法定主义的轨道。     

试论“私募基金”在我国的发展

私募基金作为一种投资工具在我国还尚未正式出现 ,而是以各种形式存在于地下。必须对私募基金进行常识性的介绍、分类和比较 ,才能看出私募基金的规范和健康发展对我国经纪业、证券业、资本市场乃至整个国民经济产业结构具有深远影响。并且显示出私募基金的存在是资本增殖内在要求这一主题。可以说私募基金的发展具有历史必然性和现实迫切性     

‘The Muncy–Vitell Consumer Ethics Scale: A Modification and Application’

This study compares college students with other adults in terms of the Muncy–Vitell (1992) consumer ethics scale. Further, the study updates the Muncy–Vitell consumer ethics scale with modifications that include rewording and the addition of new items. These new items can be grouped into three distinct categories – (1) downloading/buying counterfeit goods, (2) recycling/environmental awareness and (3) doing the right thing/doing good. The study also compares these two groups in terms of their attitude toward business. Results show that there is indeed a significant difference between these two groups in terms of ethical perceptions, but not in terms of the “recycling” items and the “doing good” items. There was also little difference between the groups in terms of their attitude toward business indicating that attitude toward business does not explain their different ethical perspectives.     

关于民间融资及司法调节的初步思考——基于温岭市的实证分析

民间融资以民间信用为基础,广泛存在于企业之间、公民之间、企业与公民之间,包括非法与合法融资,融资方式具有广泛性、隐蔽性、复杂性等特征,在经济发展中发挥了积极作用,但其存在的问题和风险亦不容忽视。温岭民营经济发达,涉及民间融资的案件多发,在基层司法中具有一定代表性。本文基于温岭民间融资实况调研,分析民间融资存在的问题及司法调节难点,从政府层面及司法层面探索引导民间资本合理流向的应对举措。     

保险市场违法违规行为分析

良好的保险市场秩序,是保险业健康发展的必要条件。近年来,随着我国保险业的持续高速增长,保险市场违法违规行为也在不断增多,扰乱了保险市场正常秩序,影响到我国保险业的可持续发展。本文从保险产业链的角度分析我国保险市场存在的问题,进而提出应对思路,期望能对我国保险业的实践和理论研究有所裨益。
